Terms and Conditions


    1. ("the Website") enables consumers to purchase Dermalogica Products (“Products’”) online.
    2. The Website is owned and operated by the Dermal Institute of South Africa (Pty) Ltd (2006/000711/07), a company incorporated in the Republic of South Africa (hereinafter referred to as “Dermalogica” or “we” or “us”).
    3. All visitors to the Website ("Users" or "you") will be able to see the Products on offer, but only those who have registered for an account on the Website ("Dermalogica account holders” or “you” or “buyer”) are able to purchase Products online.
    4. Only account holders residing within the borders of South Africa may purchase Products online.
    5. By accessing, registering and using the Website Users and Dermalogica account holders, including those that buy from the Website ("buyers"), are bound by these Terms and Conditions (“the Terms and Conditions”) and are deemed to have read and accepted these Terms and Conditions.
    6. If you have accessed the Website from a specific link on a Dermalogica Online Affiliate’s (Affiliate) website you will be bound by these terms and conditions and are deemed to have read and accepted these terms and conditions.
    7. “Dermalogica Online Affiliate” (“ Dermalogica Accredited Affiliate” or “Affiliate”) is an authorised stockist of Dermalogica that has met our Online Affiliate Program criteria.

    1. When you access or use the Website, sign up for a Dermalogica newsletter, opt into marketing communication, register an account, conclude a purchase or transaction, or send an email to [email protected], you agree to receive electronic communication from Dermalogica and you are able to ‘opt out’ at any given time.

    1. When you access or use the Website, you confirm that this will not be done for any purpose that is unlawful or prohibited by the Terms and Conditions and any notice displayed on the Website.
    2. Any unauthorised commercial use of the Website and its services, or the resale of its Products and services, is expressly prohibited.
    3. You may not use the Website in violation of the South African laws and Regulations, and if you access the Website from locations outside of South Africa then the User is responsible for compliance to all local laws and regulations.

    1. The contents of the Website, including any material, information, software, icons, text, graphics, layouts, images, sound clips, advertisements, video clips, trade names, logos, trademarks, designs, copyright and all other forms of intellectual property displayed on and/or incorporated in the Website (“Website Content”,), are protected by law, including but not limited to copyright and trademark law.
    2. The Website Content is the property of Dermalogica, its advertisers and/or sponsors and/or is licensed to Dermalogica.
    3. You will not acquire any right, title or interest in or to the Website or the Website Content.
    4. Any use, distribution or reproduction of the Website Content is prohibited unless expressly authorised in terms of these Terms and Conditions, or otherwise provided for in law.
    5. Where any of the Website Content has been licensed to Dermalogica or belongs to any third party, your rights of use will also be subject to any terms and conditions which that licensor or third party imposes from time to time and you agree to comply with such third party terms and conditions.

    1. All Products displayed on the Website are limited and are subject to availability.
    2. Dermalogica will make all reasonable attempts to ensure that when the stock is no longer available the item, in particular, is discontinued on the Website.
    3. If we are not able to fulfil any order because the stock item is sold out, we will inform you and you'll be entitled to a reimbursement for the Rand value you have paid for such stock item.
    4. Dermalogica reserves the right to distribute promotional items solely on the Website.
    5. We will make all reasonable attempts to ensure that promotional items are brought to an end when stock runs out.
    6. Dermalogica reserves the right to communicate Product changes to you on the Website, this may include but is not limited to, the discontinuation of Products, packaging changes, name changes and formula changes.

    1. Certain Dermalogica Products carry an expiry date.
    2. This date is clearly printed on both the outer carton and also on the Product container.
    3. Dermalogica’s commitment to the User is that at the time of delivery of any order to you, all Products carrying expiry dates will have a minimum of 6 (six) complete months to that date.
    4. If you receive a Product, that has been purchased on the Website, that expires in less than 6 (six) months at the time of receipt then we will replace that Product free of charge.
    5. In order to receive your replacement free of charge, you will need to do the following
      1. Click ‘Contact us”, select ‘Return product’ and ‘I have received an expired product’ from the drop-down menu within 14 (fourteen) working days of receiving your order.
    6. If such notification is not received within this time frame then Dermalogica makes no guarantee or commitment with regard to replacing the Product.

    1. The Website allows you, the User, to place electronic orders ("order") for one or more Products on offer as long as the Products are available and are not sold out.
    2. A sale agreement ("sale") between you and Dermalogica will only come into effect when you have fully completed all of the following:
      1. Fully completed AND submitted the online order form for one or more Products in your basket ("shopping cart").
      2. Your payment has been authorised by Dermalogica and/or has been received into Dermalogica's bank account.
      3. The Product is available.
    3. You are not able to reserve Products to be bought at a later stage, and placing an item in your basket or adding an item to a “Wishlist”, without fully completing the order, as detailed in 7.2 above, does not amount to a sale or an order.
    4. If a Product goes out of stock before the sale actually takes place, Dermalogica is able to remove any item from your basket.
    5. Dermalogica may not be held responsible if an order has become unavailable by the time you try to complete a purchase at a later stage.
    6. The invoice for your purchase will be available online in your account on the Website and a copy of this invoice will be included in your parcel.
    7. Record keeping of transactions:
      1. Complete records of each transaction between you and Dermalogica are kept on the Website in your account for 12 (twelve) months after a particular purchase or related transaction.
      2. During this stipulated time, you'll be able to view and print out these records.
      3. After the 12 (twelve) month period the responsibility of keeping such record falls onto you.
    8. When you purchase through an Affiliate’s Website, mixed baskets are not permitted This means that only Dermalogica Products advertised on the Website may be purchased by the User.

    1. Dermalogica reserves the right to refuse the processing of payment for any order and/or to cancel any purchase, partially or completely, with notice given to you.
    2. In such an instance we will be liable to reimburse you the Rand value paid only if you have already paid for the cancelled order and the payment has reflected in the Dermalogica bank account.
    3. You are entitled to cancel, either in part or in whole, any purchase without incurring any administration fees if your order has not already been packed at our Warehouse.
    4. You will need to cancel the order on your order page on the Website.
    5. If you cancel your order after the order has been packed at the Warehouse, you will be refunded after the deduction of a 10% administration charge.
    6. You have the right to return the item(s) purchased (click here to access Dermalogica's Returns Policy for more information).
  9. FRAUD

    1. Dermalogica reserves the right, in the interest of preventing fraud, to refuse to accept or process payment for any order and/or to cancel any purchase, partially or completely.
    2. We also reserve the right to blacklist the User from the Website should we suspect that the User is fraudulently and unlawfully distributing the goods purchased from the Website.
    3. In such an instance Dermalogica will only be liable to refund monies already paid by the User and will provide notice to the User.
    4. Dermalogica accepts no liability which may arise as a result of such blacklisting and/or refusal to process any order/sale.
    5. Dermalogica may request documentation to complete the necessary fraud checks and cancel any order where the necessary documentation is not provided in a timely manner.
    6. In the event of a fraudulent purchase being made on the Website, the cardholder is recommended to initiate a chargeback via their bank in order to be reimbursed.
    7. Dermalogica will not process refunds for orders that are suspected of fraud.
    8. Dermalogica does not provide order details relating to orders that are suspected of fraud.

    1. The price of each Product is displayed on the Product listing and if there is a special offer the promotional price will be displayed.
    2. All listed Product prices are subject to Value Added Tax of 15%.
    3. If you have pre-ordered Products before the public release date, and the price of the Product at the time of release is lower than the price you paid, we will credit your account with the difference or provide you with a redeemable voucher, at Dermalogica’s discretion.
    4. We will take all reasonable efforts to accurately display prices and delivery charges.
    5. If, however, the Product is offered at an erroneous price (or an incorrect delivery cost is displayed), Dermalogica is not be obliged to supply Products at the incorrect price/delivery fee.
    6. We will only be liable to return payment already made by you should you not wish to continue with the purchase at the correct price and/or delivery charge.
    7. If an Affiliate erroneously lists an incorrect Product price on their Website, Dermalogica will not be obligated to honour this incorrectly listed price.

    1. We accept payments may be made by Visa, MasterCard, Diners or American Express credit cards, debit cards, Instant EFT, Mobicred and Payflex.
    2. When you place an order, the transaction details will be presented to your bank for authorisation of the payment amount.
    3. If the authorisation is not obtained, the order will be cancelled.
    4. If authorisation is obtained, payment is usually immediate.
    5. You guarantee when you process your payment, that you are fully authorised to use the credit card for payment of your order and that there are sufficient funds in this credit card account to cover the costs of any transactions you complete on the Website.
    6. Credit Card Transactions will be completed via an approved payment gateway.
    7. The payment gateway will use the strictest form of encryption and no credit card details will be stored on the Website.
    8. Your details will be stored separately from your credit card details.
    9. The transaction currency is South African Rand (ZAR).
    10. Dermalogica is in no way responsible for any loss incurred to the User from fraudulent transactions occurring on their account, arising from the User entering their credit card details on the Website.

    1. Dermalogica may release printed or digital vouchers and/or promotion code and or coupon (“voucher”) from time to time that will allow you to be able to redeem against your online purchases.
    2. These vouchers may be available through the Website and/ or from a third-party Website, in magazines and other media.
    3. Vouchers may only be redeemed against your purchase on the Website as long as the vouchers are valid and specified expiry dates cannot be moved.
    4. Vouchers must be used while they are valid, are not redeemable for cash and will not be replaced if the physical voucher is lost, stolen, destroyed or used without permission.
    5. Vouchers are not transferable, cannot be exchanged for cash and cannot be used to purchase another voucher.
    6. A voucher can only be used against a purchase once and the full amount of the voucher is required to be redeemed as any difference between the purchase transaction and the voucher will not be redeemed in cash.
    7. The value of the voucher will be deducted from your total amount in your shopping cart and the remaining balance must be paid by you.
    8. If you have redeemed a voucher against a purchase and you’d like to return all items purchased, we will refund you or credit your account with the Rand value of the purchase and reissue the voucher with the same associated terms and conditions.
    9. If you have redeemed a voucher against a purchase and you would like to return only some of the items purchased, we will recalculate the total value of your purchase AFTER the returned item(s) has/have been deducted.
    10. Dermalogica also makes available on the Website electronic gift vouchers that may be purchased to be redeemed against purchases. Currently, this functionality is not available on the Website.
    11. Gift vouchers can only be redeemed while they are valid and expiry dates will not be able to be extended.
    12. Gift vouchers cannot be used to purchase other vouchers or gift vouchers nor exchanged for cash.
    13. You are able to set the gift voucher value to any value between R100 and R10 000 and the chosen value may only be in Rands and no cents will be permitted.
    14. You will be able to redeem more than one gift voucher against your purchase.
    15. You will be able to check the balance of your gift voucher within your account on the Website.
    16. You may purchase a gift voucher for use on the Website by yourself or as a gift for a third party.
    17. The gift voucher will be sent to you or your chosen recipient via email.
    18. Gift vouchers are not refundable for cash once purchased and can only be redeemed against online purchase transactions on the Website.
    19. The credit of a gift voucher does not accrue any interest nor does it have a cash value.
    20. The value of the gift voucher will be deducted from your total amount in your shopping cart and the remaining balance must be paid by you.
    21. Vouchers are valid for a period of three years from the date of purchase.
    22. Dermalogica may also release printed or digital vouchers and/or promotion codes and/or coupons (“vouchers”), from time to time, that will be redeemable against purchases from approved third-party Affiliates. Any such vouchers may be redeemed only in store at these Affiliates and only as long as they are valid. Any purchases and transactions made with any Affiliate remain strictly between the User and the Affiliate, irrespective of whether a voucher obtained from Dermalogica is used or not. For further detail regarding Affiliates and transactions, please see clause 25.

    No current competitions




    1. Dermalogica charges delivery fees based on the ZAR amount of the total purchase transaction (excluding VAT).
    2. The delivery charge will be calculated and specified upon checkout of the relevant Product or Products ordered and will be calculated based on the available Product information.
    3. Delivery charges are as follows:
      1. The purchase transaction is less than R700 with standard delivery times – R100.
      2. The purchase transaction is greater than R700 with standard delivery times – free of charge.
    4. Delivery charges quoted in 14.3 above are subject to petrol price changes and/or price increases and may be updated as and when required at Dermalogica’s sole discretion.
    5. Dermalogica at times will run promotions where delivery is free of charge. The relevant terms and conditions will be outlined in the Promotional Items section contained in this document.

    1. Dermalogica delivers orders within business hours only in the Republic of South Africa.
    2. We deliver door to door or door and are sent to a street address.
    3. No PO Box deliveries will be permitted.
    4. The User will need to indicate where in South Africa you require delivery, as well as contact numbers to be used in connection with the delivery.
    5. Your parcel will be delivered to the address you specify in the checkout process.
    6. If nobody is present at the address at the time of delivery, our courier will use the mobile phone number you provided in your order to indicate that a delivery was attempted.
    7. The courier will try only once more (two attempted deliveries), and if at that time there is still no one to sign for the parcel, it will be your responsibility to call the Dermalogica call centre (011) 268 1001 or send an email to [email protected] to arrange delivery.
    8. If you do not contact the Dermalogica call centre within 5 (five) working days of the courier attempting the second delivery, the courier will return the parcel to Dermalogica, and we will contact you via email to discuss potential redelivery at your own expense.
    9. If this attempt does not succeed within a reasonable amount of time, we will simply reimburse you subject to a deduction of a 10% administration fee.

    1. Delivery timeframes are regarded as having started upon confirmation of payment received by Dermalogica.
    2. Subject to stock availability and receipt of payment, orders will be processed within 2 working days and handed over to a courier company for delivery to you.
    3. Unless we inform you otherwise before you place your order and before the final confirmation, the estimated maximum delivery time for an order is 2-4 working days.
    4. Deliveries are made to street addresses, therefore no deliveries to PO Box addresses.
    5. All deliveries take place during business hours only This means that there will be no deliveries made over weekends or on public holidays.
    6. You will need to take this into consideration when selecting your delivery address.
    7. Dermalogica will supply all goods to the delivery company in good order and will ensure that the goods purchased are delivered to your chosen delivery address in the same order.
    8. Dermalogica will within reason ensure that delivery information supplied on the Website is accurate and where delays are incurred with deliveries every reasonable effort will be made to inform you.
    9. Unless otherwise specified the modes of delivery offered are:
      1. Door to Door courier with RAM from Monday to Friday from 8am-5pm.
      2. RAM reserves the right to organise the delivery of an order to a predetermined meeting place with a User should specific areas be determined as ‘High-Risk Areas’. This list of areas is managed by RAM and is done so independently of Dermalogica.

    1. A delivery is considered complete as soon as the parcel is handed to an individual at your specified delivery address.
    2. This also applies when the package has been handed over by the courier, as indicated in the courier's tracking system.
    3. It is your responsibility, as the buyer, to ensure that you or the intended receiver inspect(s) the parcel on arrival and makes any justifiable complaints known.
    4. The receiver has the right to refuse the parcel if in any way it appears to have been opened or if it has clearly been damaged.
    5. Such complaints and claims must be brought to the attention of Dermalogica by calling our call centre at (011) 268 1001 (Monday to Friday, 8 am to 5 pm).

    1. If neither the Warehouse nor the tracking system provides any indication where the parcel is, you need to call the call centre at (011) 268 1001 or send an email to [email protected].
    2. If the parcel is found, it will be sent to the specified delivery address by the usual procedure, as set out in 14,15 and 16 in this document.
    3. If the parcel is declared lost, Dermalogica will notify the buyer and reimburse the buyer for the lost parcel (of the amount of the Product purchase price and any relevant delivery fee).

    1. If you are unsatisfied with your purchase after receiving the Product, you may return it to Dermalogica within 14 (fourteen) days of delivery, without reason and without penalty, in order to obtain a full purchase price refund or have the Product replaced, subject to the conditions stipulated in our Returns Policy.
    2. All complimentary products, gifts, and sample sachets are exempt from point one (1) in this clause. Should you wish to exchange, return or replace a free product, gift or sample sachet, we are happy to facilitate your request at an R200 service fee which can be handled by contacting our Customer Services department.

    4. You are not entitled to any refund, repair or replacement save to the extent that it is expressly provided for under this Refund Policy.

    1. If you have any complaints regarding the standard and quality of the Product/s bought on the Website and after-sales,case should be created.
    2. An after-sales case can be created by clicking ‘contact us’ where you will be able to provide us with your feedback.

    1. A User that attempts to deliver or delivers any damaging code to the Website or attempts to gain unauthorised access to any page on the Website will be prosecuted.
    2. Dermalogica will claim civil damages from the User if Dermalogica suffers any damage or loss.
    3. You agree that your login name and password will be used for your own personal use and will not be disclosed to any third party.
    4. You allow Dermalogica to take any steps reasonably possible to ensure the integrity and security of the Website and in the administrative office.
    5. Dermalogica undertakes that it has taken all reasonable precautions to secure the credit card processing that is carried out to receive payment for goods sold.
    6. Dermalogica has no access to any confidential information regarding your payment method.
    7. Only Dermalogica's banking partner will access confidential information (such as your credit card number, expiry date, CVV etc.) from time to time.
    8. Dermalogica cannot be held responsible for security breaches occurring on the User's electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.

    1. Dermalogica is required to take all reasonable steps to protect your personal information.
    2. For the ends of this clause, " personal information" is defined according to our complete privacy policy which can be viewed here.
    3. Dermalogica is authorised to gather, store and use the following of your information:
      1. Name and surname
      2. Date of birth
      3. Sex
      4. Nearest city
      5. Non-personal click patterns
      6. Email address
      7. IP address, and
      8. ID or passport number
    4. Dermalogica is permitted to gather, store and use the above information for the following purposes:
      1. To greet and welcome you when you access the Website.
      2. To inform you (if you have agreed to this) of facts regarding your access and use of the Website.
      3. To inform you (if you have agreed to this) of competitions and promotions offered by Dermalogica or its Affiliates.
      4. To set up non-personal statistics about internet habits, click patterns and access to the Website.
      5. To verify your identity when you make a transaction through
      6. To ensure the Products are received by the addressee.
      7. For remarketing purposes.
      8. The above information is either gathered electronically through the use of cookies or provided by you voluntarily You can regulate the use of cookies independently with your personal search engine settings (refer to the cookies section of terms and conditions for further details).
      9. To put you into contact with Dermalogica Accredited Affiliates in order to go into a store for a Dermalogica treatment (if you have agreed to this).
      10. You can choose to not receive any direct marketing information from Dermalogica and its Affiliates.
    5. Dermalogica and its Affiliates are entitled to gather, store, compile and share any information gleaned from you, subject to the following conditions:
      1. Dermalogica and its Affiliates may not make any of your personal details public unless you have agreed to it, or unless it is required for the purposes of any judicial process.
      2. Dermalogica and its Affiliates may compile, use and share any information that has no bearing on any particular individual, and Dermalogica and its Affiliates owns and reserves the right to non-personal statistical information gathered and compiled by Dermalogica.
      3. You acknowledge and agree that certain personal information (such as your full name, delivery address, email address and contact details) may be passed onto the courier company to ensure delivery of the Products you have bought.
      4. Dermalogica will not share any personal information with Dermalogica Accredited Affiliates unless you have expressly agreed to it or you have personally chosen to share your details.

    1. A cookie is a basic text file that is stored in an electronic device (such as a computer, mobile phone, tablet or other) by a Website’s server.
    2. A cookie is unique to the User’s web browser and contains anonymous information.
    3. It allows a Website to remember information such as a User’s Product preferences and what is in the User’s shopping basket.
    4. The Website utilises first and third-party cookies in order to improve your experience of the Website through web analytics tools and to display more relevant advertising to users who have visited the Website.
    5. Most web browsers provide the option to block some or all cookie types should you wish to. You may disable the use of cookies by configuring your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do so, you may not be able to enjoy all of the features and functionality of the website.
    6. Dermalogica recommends that you do not block cookies as many of the features of the Website utilise cookies to enhance your experience of the Website but the choice is entirely up to you as our customer.

    1. No person, business or Website may be linked to any page on this site without prior written permission from Dermalogica
    2. Such permission can only be obtained by participating in the Dermalogica Online Affiliate Program.
    3. Links to non-Dermalogica Websites given on the Website are provided “voetstoots” and we do not necessarily agree with the content of such Websites, as we are unable to edit or underwrite such Websites.
    4. No person, business or Website may use any technology to glean information from this Website without prior written permission from Dermalogica.

    1. The information and services available on the Website or the Websites belonging to an Affiliate may include inaccuracies or typographical errors.
    2. Dermalogica makes no guarantee on the availability, accuracy or completeness of the content on the Website or the content on the Websites belonging to, and maintained by the Affiliates.
    3. Dermalogica provides no guarantee that the content, or technology attached to the Website or Affiliate’s Website is free from errors or omissions.
    4. Dermalogica cannot guarantee that service will be 100% uninterrupted or faultless.
    5. If you have experienced any malfunction or error please ensure that this reported to [email protected]
    6. You specifically agree that Dermalogica shall not be responsible for non-authorised access to or alteration of your transmissions or data, any material or data sent or received or not sent or received, or any transactions entered into through the service.
    7. Dermalogica and/or its respective suppliers or Affiliates make no representations about the suitability, reliability, availability, timeliness, and accuracy of the service for any purpose.
    8. Dermalogica and its services are provided "as is" without warranty of any kind.
    9. Dermalogica and/or its suppliers and/or Affiliates will not be liable for the following:
      1. Any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Website and its services, or related Websites.
      2. With the delay or inability to use the Website and its services or related websites.
      3. The provision of or failure to provide services.
      4. Or for any information, software, products, services and related graphics obtained through the service.
      5. Or otherwise arising out of the use of the service.
      6. Whether based on contract, tort, negligence, and strict liability or otherwise, even if Dermalogica or any of its suppliers or Affiliates has been advised of the possibility of damages.
    10. If you are dissatisfied with any portion of the service, or with any of these terms of use, it is your sole and exclusive remedy is to discontinue using the service and its related Websites.
    11. The Website may contain links or references to other third party websites and Affiliates outside of our control, including those of advertisers and stockists, while third-party Affiliates and websites may also provide links or references to the Dermalogica Website. These Terms and Conditions do not apply to those Third Party Affiliates, their websites, and any other websites linked to or from, and Dermalogica is not responsible for the practices and/or privacy policies of those Third Party Affiliates and other websites or the “cookies” that those sites may use.
    12. Notwithstanding the fact that the Dermalogica Website may refer to or provide links to Third Party Affiliates and other websites, or vice versa, your use of such Third Party Affiliates and other websites is entirely at your own risk and we are not responsible for any loss, expense, claim or damage, whether direct, indirect or consequential, arising from your use of, or transactions with, such Third Party Affiliates and other websites, or your reliance on any information obtained from them, whether it be online or not.

    1. Dermalogica is responsible for adhering to the Consumer Protection Act 68 of 2008 with the sale of any Products from the Website.
    2. Moreover, Dermalogica is responsible for adhering to articles 43(5) and 43(6) of the Electronic Communication and Transactions Act in terms of payment systems and security.
    3. However the User agrees to indemnify and hold Dermalogica, its parent companies, subsidiaries, affiliates, officers and employees, and suppliers harmless from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of the User’s use of or conduct on the Website and its services.

    1. Dermalogica is entitled to terminate these Terms and Conditions or close down the Website at any time, with or without cause, with or without notice, effective immediately, for any reason whatsoever.
    2. Dermalogica and its Affiliates reserve the right to refuse service, termination of accounts, remove or edit content or cancel orders in their sole discretion.

    1. Dermalogica reserves the right to change these Terms and Conditions, or any part thereof, at its own discretion.
    2. If you are an account holder, Dermalogica will inform of the changes via email (the address you include in your registration).
    3. At this point, it will be your responsibility to ensure that you read through the revised Terms and Conditions and are satisfied with the updates.
    4. If you are not satisfied with any amendments to the Terms and Conditions, you have the right to terminate your account with Dermalogica.
    5. If you do not have a registered account with Dermalogica, we will be unable to send you the amendments and if you enter into any transactions with Dermalogica it will be deemed that you have accepted the amendments.
